This Agreement is between you and findthedifference.net (hereinafter: "Game", "Site", "us", "we", or "our") and pertains to your use of our game, website, and services, including any materials and content available therein, and any successor site(s) or game versions thereto (the "Service").
BY PLAYING Find The Difference OR USING THE SITE, YOU AGREE TO THESE TERMS OF SERVICE AND CONFIRM THAT YOU ARE OLDER THAN 13 YEARS. Any reference to "you" or "your" in this Agreement applies to the individual who uses the Service.
It is important to note that this Agreement includes a mandatory arbitration provision, which is further explained in Section 11 below. This provision requires the use of arbitration on an individual basis to resolve disputes, rather than jury trials or any other court proceedings, or class actions of any kind. Therefore, please review this section carefully.
CHANGES
This Agreement may be amended by us periodically, and we will notify you of such changes through any reasonable means, which may include posting a revised Agreement on the Site, in-game notifications, or email notifications. Any changes made will not apply to any disputes between you and us that arose prior to the date on which we posted the revised Agreement incorporating such changes, or otherwise notified you of such changes.
By using the Service after any changes to this Agreement, you agree to be bound by the revised terms, and such continued use will be deemed an irrefutable presumption of your acceptance of the changes. The date of the last update to this Agreement is indicated by the "Last Updated" legend above.
We reserve the right to modify, suspend, or discontinue all or part of the Service (including game features, servers, or access through any third-party platforms), and we may charge, modify, or waive any fees required to use the Service. Additionally, we may offer opportunities, events, or features to some or all players at any time without incurring any liability.
INFORMATION SUBMITTED THROUGH THE SERVICE
The submission of information through the Service is subject to the findthedifference.net Privacy Policy, which can be found at https://findthedifference.net/privacy-policy/ (referred to as the "Privacy Policy"). By using the Service, you acknowledge and agree to the Privacy Policy.
You affirm that any information you provide in connection with the Service is accurate and complete, and you commit that you will maintain and update such information as needed. If there are any discrepancies between the provisions of this Agreement and the Privacy Policy regarding personal data, the provisions of the Privacy Policy will take precedence.

- You must not cheat, exploit bugs, use unauthorized third-party software, or engage in any activity that provides an unfair advantage or disrupts the game experience for other players.
- You must not use the Service for any commercial purpose that is not authorized by findthedifference.net or for any fraudulent, tortious, or unlawful purpose.
- You may not collect information about other players except as permitted by the Privacy Policy.
- You must not interfere with or disrupt the Service's operation or the servers or networks used to make the Service available. This includes hacking, DDoS attacks, or violating any server or network requirement, procedure, or policy.
- You must not restrict or inhibit any other person from using the Service.
- You may not reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute, or otherwise exploit any portion of the Service without our express prior written consent.
- You may not reverse engineer, decompile, or disassemble any portion of the Service, except where such restriction is expressly prohibited by applicable law.
- You must not remove any copyright, trademark, or other proprietary rights notice from the Service.
- You may not frame or mirror any portion of the Service or incorporate any portion of the Service into any product or service without our express prior written consent.
- You may not systematically download and store game assets or content.
- You may not use any robot, spider, site search/retrieval application, or other manual or automatic device to retrieve, index, "scrape," "data mine," or otherwise gather Service content, or reproduce or circumvent the navigational structure or presentation of the Service, without our express prior written consent.
- You must not sell, trade, or transfer game accounts, virtual items, or currency for real money or other value.
- You must not impersonate findthedifference.net staff or other players.
- You are responsible for obtaining, maintaining, and paying for all hardware, software, internet connection, and other services needed to use the Service.
USER GENERATED CONTENT
The Service may allow you to create, upload, or share content such as character designs, gameplay videos, screenshots, or comments ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.
You represent and warrant that you own or have the necessary rights to all User Content you submit, and that such content does not violate any third party rights or applicable laws.
MONITORING
We may (but have no obligation to) monitor, evaluate, alter or remove User Content or player behavior before or after it appears in the Service. Additionally, we may analyze your use of and access to the Service for security, game balance, and improvement purposes.
We may disclose information regarding your use of and access to the Service, including the circumstances surrounding such use and access, to anyone for any reason or purpose, without prejudice to the Privacy Policy.
THIRD-PARTY MATERIALS: LINKS
The Service may provide access to Third Party Materials, such as social media platforms, payment processors, advertisements, and external websites through links or integrations. By using this functionality, you are instructing us to facilitate access to the applicable Third Party Materials.
We do not control or endorse Third Party Materials, including their accuracy, validity, timeliness, completeness, reliability, integrity, quality, legality, usefulness, or safety, nor are we responsible for any intellectual property rights associated with such materials. This Agreement does not cover Third Party Materials. We are not obliged to monitor Third Party Materials, and we may block or disable access to any such materials through the Service at any time.
ATTENTION: YOUR USE OF THIRD-PARTY MATERIALS IS AT YOUR OWN RISK AND SUBJECT TO ANY ADDITIONAL TERMS, CONDITIONS, AND POLICIES APPLICABLE TO SUCH MATERIALS, SUCH AS THE TERMS OF SERVICE OR PRIVACY POLICIES OF THE PROVIDERS OF SUCH MATERIALS.
VIRTUAL ITEMS AND CURRENCY
The Service may include virtual currency, items, or other virtual goods ("Virtual Items"). Virtual Items have no real world value and cannot be redeemed for real money, goods, or services. We grant you a limited, non-transferable, non-sublicensable, revocable license to use Virtual Items solely within the Service.
We reserve the right to modify, manage, control, or eliminate Virtual Items at any time. Prices and availability of Virtual Items are subject to change without notice. We have no liability for hacking or loss of your Virtual Items.
DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW: (A) THE SERVICE AND ANY PRODUCTS AND THIRD PARTY MATERIALS ARE MADE AVAILABLE TO YOU ON AN "AS IS," "WHERE IS" AND "WHERE AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY; AND (B) Find The Difference DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SERVICE AND ANY PRODUCTS AND THIRD PARTY MATERIALS, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND TITLE.
Although we strive to keep the Service timely, secure, and accurate, we cannot guarantee that the Service will remain updated, complete, correct, or secure or that access to the Service will be uninterrupted. The Service may contain errors, bugs, and unauthorized third-party alterations may occur. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Find The Difference BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless findthedifference.net and its officers, directors, employees, and agents from any claims, disputes, demands, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
DISPUTE RESOLUTION AND ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and findthedifference.net and that any dispute will be resolved solely through individual arbitration and will not be brought as a class action, or any other type of representative proceeding.
Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.
YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND Find The Difference ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
TERMINATION
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
COPYRIGHT INFRINGEMENT CLAIMS
If you believe that content available through the Service infringes your copyright, you (or your agent) may send us a written notice requesting that we remove such content or block access to it. Similarly, if you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you may send us an email at [email protected].
We recommend that you seek the advice of your legal counsel before filing any notice or counter-notice.
MISCELLANEOUS
This Agreement shall not create, and should not be construed as creating, any partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship between you and FindTheDifference.net. If any provision of this Agreement is deemed unlawful, void, or unenforceable, that provision shall be considered separate from this Agreement, and its removal shall not impact the validity or enforceability of any remaining provisions.
You may not assign, transfer, or sublicense any of your rights or obligations under this Agreement without our express written consent. We, however, reserve the right to assign, transfer, or sublicense any or all of our rights or obligations under this Agreement without any restrictions.
The waiver of any breach or default under this Agreement by either party will not be considered a waiver of any previous or subsequent breaches or defaults. All defined terms used in the singular form shall have the same meaning when used in the plural form, where applicable, and unless otherwise specified.
This Agreement, along with any terms and conditions incorporated herein, constitutes the entire agreement between you and findthedifference.net regarding the same.
findthedifference.net shall not be liable for any failure to fulfill any obligation due to any cause beyond its control.
